The North Texas Healthcare Compliance Professionals Association (NTHCPA) invites members and other interested health care compliance professionals to join us on Tuesday, May 19, 2015 from 11:30 a.m. to 1:30 p.m. for our Study Group Luncheon featuring on “”Healthcare Governing Board Best Practices For Compliance Oversight.”

During the program, NTHCPA President Erma Lee, Compliance and NTHPCA Vice President Cynthia Marcotte Stamer will brief participants on the tips and guidance provided in the “Practical Guidance for Health Care Governing Boards on Compliance Oversight,” jointly released on April 20, 2015 by the Inspector General of the Department of Health and Human Services (HHS OIG), the American Health Lawyers Association (AHLA), the Association of Healthcare Internal Auditors (AHIA) and the Health Care Compliance Association (HCCA) to assist governing boards of health care organizations to carry out what HHS views as their compliance plan oversight obligations. Following the briefing, Ms. Lee and Ms. Stamer will facilitate a discussion and sharing among participants about strategies for using this new resource along with other OIG guidance and participant’s experiences to help their health care organizations, boards and leaders carry out and document their compliance and compliance oversight responsibilities to help promote defensibility in the event of an investigation or audit.

About the Speakers

NTHCPA President, Erma Lee, CHC and NTHCPA Vice President Cynthia Marcotte Stamer, Esq. will lead this month’s discussion.

Ms. Lee is the Compliance Officer for JPS Health Network in Fort Worth, Texas, the county hospital system responsible for caring for the needs of families in Tarrant County, Texas. In her role with JPS Health Network, Ms. Lee oversees and leads the compliance activities for the system including supporting its Board with their oversight of the compliance efforts of the organization and its activities. Ms. Lee is certified in Healthcare Compliance and is a member of the Healthcare Compliance Association, American Healthcare Lawyers Association, Privacy Officers Association and the National Association for Health Services Executives.

A practicing attorney and health industry thought leader, advocate and author with more than 27 years’ experience advising, representing and defending health and managed care organizations, their board and other leaders, and others on legal and operational compliance, risk, performance and other legal and operational management and health industry concerns. In her role as outside operations and special counsel, Ms. Stamer has worked extensively with health care organization boards and other leaders to design, oversee, administer and defend compliance, risk management, governance and other policies, programs, practices to promote legal and operational compliance and defensibility.. An attorney Board Certified in Labor & Employment Law by the Texas Board of Specialization, Ms. Stamer’s experience includes advising and supporting health care organizations, their boards and other leaders to anticipate and respond to statutory, regulatory and enforcement, contractual and operational compliance and performance management needs and challenges, to assess, design, document and communicate, administer, monitor and defend governance, internal controls, up the ladder reporting and oversight, and other compliance and risk management policies and practices, to conduct and respond to audits and investigations, and to implement, enforce and defend these practices. As a serial board member and audit committee chair of various non-profit health care and professional organizations, Ms. Stamer brings to the table an understanding of both the legal and other management challenges of organizations, their boards and other leaders. A widely published author and frequent speaker who serves in the leadership of many professional and civic organizations, Ms. Stamer also conducts board, leadership, and compliance training for a broad range of health industry and other organizations including the Medical Group Management Association, Decision Health, the Health Care Compliance Association, the Association of State and Territorial Health Care Organizations, the American Bar Association, the American Health Lawyers Association, numerous medical societies and others. She also annually serves as a planning committee member and faculty member of numerous health and managed care and other programs and conferences. To accommodate the anticipated larger than anticipated attendance, the meeting will be held at the offices of Medsynergies in Irving, Texas. During this second annual visit from the Dallas Regional OCR Office, Ms Nwigwe will share the latest about OCR’s rules, audits, enforcement of the Health Insurance Portability & Accountability Act (HIPAA) Privacy, Security and Breach Notification rules, and the health care Civil Rights rules enforced by OCR and provide tips to help health care organizations promote compliance and deal with OCR in audits, enforcement or other situations.

NTHCPA encourages members and other interested health care compliance professionals to register early to reserve their spot to participate.

Please note that the meeting will take place on a special date, Wednesday, March 18, and at a different meeting location. While NTHCPA’s monthly meeting usually takes place on the third Tuesday of the month, the March meeting has been moved to the third Wednesday, March 18 to accommodate the scheduling needs of Manager Nwigwe. Additionally, the location of the meeting has been moved to expand NTHCPA’s ability to accommodate the higher than usual expected attendance. To expand available seating to meet expected demand, MedSynergies has agreed to host the meeting in its training rooms.  North Texas Health Care Compliance Association (NTHCPA) invites NTHCPA members and other health industry leaders to discuss these concerns, share best practices, and explore other concerns joining with other NTHCPA members and guests for an open forum discussion on “The ACO: The New Tie that Binds” at the next NTHCPA Study Group Luncheon on January 20, 2015.
Kenya will discuss the opportunities and challenges posed by ACOs as well as other business and operational implications. She will explore the role of specialists in this new primary care driven healthcare economy and how primary care providers are responding to their new-found popularity. She will also discuss the implications of ACOs and narrow networks on provider business models.

About the Speaker: Kenya Woodruff

 Kenya S. Woodruff is Counsel at Haynes and Boone, LLP in the Healthcare practice group. She provides advice to health systems, hospitals, accountable care organizations, ambulatory surgery centers, physician groups, diagnostic imaging centers, and pharmacies on regulatory and transactional matters. She has more than 15 years of experience, having previously served as a Compliance Officer and Privacy Officer of a national publicly-traded radiology services company and as Deputy General Counsel at a large urban academic medical center. In 2011, she was reappointed by the Governor of Texas to her second six-year term as a public member on the Texas Board of Chiropractic Examiners. She has held each of the executive roles in the Dallas Bar Association, Health Law Section, culminating in her tenure as chair in 2010. She was featured in D Magazine’s Best Lawyers list for Healthcare Law, 2014; selected for inclusion in Texas Rising Stars in Healthcare Law in 2009 and 2013, and Texas Super Lawyers in Healthcare Law in 2014; and invited to join the Texas State Bar College in 2013. About The Speaker, Congressman Pete Sessions

Congressman Sessions was born on March 22, 1955 and grew up in Waco, Texas.  He graduated from Churchill High School in San Antonio and went on to graduate from Southwestern University in 1978, where he now serves on the Board of Trustees. He worked for then-Southwestern Bell Telephone Company for 16 years, retiring as District Manager for Marketing in Dallas. As a businessman, he served as Chairman of the Northeast Dallas Chamber of Commerce. Thanks to this private sector experience, Congressman Sessions understands the need to fight bureaucracy and to utilize market-driven solutions to effectively solve problems in our communities and in government. In 1996, the people of Dallas and the 5th Congressional District sent Congressman Sessions to Washington, DC to represent them in the United States House of Representatives. In 2002, Congressman Sessions began representing the 32nd Congressional District, created from redistricting. In 2012, the people of the 32nd Congressional District called him back to Congress for his ninth term.

Congressman Sessions is a stalwart defender of U.S. homeland and national security interests, as well as the men and women who defend them. As the parent of a child with Down syndrome, he is a passionate advocate for people with disabilities. Congressman Sessions also believes that taxpayers deserve results from their government, and he has pursued common-sense, market-based reforms to help government operate more efficiently.

Congressman Sessions pursues his goals on these and other issues through his work on various Congressional committees and caucuses. He serves as the Chairman of the powerful House Committee on Rules, which is best known for its role as the legislative gatekeeper. In 2008 and 2010, he was elected by the House Republican Conference as Chairman of the National Republican Congressional Committee.

Whether false claims and other aggressive billing, referral or treatment practices, chemical dependency or other impairment, medical staff or other rule breaking, harassing or other disruptive conduct or a host of other personal behavioral or performance concerns, preventing and addressing personal misconduct and other risky behaviors by physicians on the staff or team of a hospital, medical practice personal misconduct often present major legal, quality, financial, political and operational challenges and risks for health care compliance, medical staff, risk management and other leaders.  Alternatively, properly directed physicians can significantly help the operation and performance of health care organizations in many critical ways.

The North Texas Healthcare Compliance Professionals Association (NTHCPA) invites members and other interested health care compliance professionals faced with these and other challenges to join us on Tuesday, September 17, 2013 from 11:30 a.m. to 1:30 p.m. for our Study Group Luncheon featuring attorney Cynthia Marcotte Stamer speaking on “Sex Drugs & Rock ‘N Role: Managing Physician Conduct in Health Care.”

While physician involvement remains an operational necessity for most hospitals, group practices and other health care organizations, these and other health care organizations and other members of their team often face significant legal, financial, reputational and operational risks when a physician becomes impaired by chemical dependency, mental illness, stress, personal tragedy or other personal impairment; is disruptive; or engages in sexual or other harassment of staff or patients, billing, treatment, referral, anticompetitive or other illegal conduct, medical board or facility rule violations, or other acts of personal or professional misconduct. While these behaviors often create major risks for health care organizations and others, successful redress of these or other physician performance or misconduct concerns often depends upon the ability to successfully negotiate a complex minefield of due process and other procedural, legal, political, operational and other challenges.

Attorney Cynthia Marcotte Stamer will use lead participants in a workshop examining these challenges and discussion of strategies to help health care organizations and their compliance officers can use to help their organization prevent, investigate and redress these and other physician performance and misconduct concerns while managing HCQIA and other peer review, licensing board, contractual, defamation and other legal, professional and operational traps that often arise out of physician discipline or other corrective actions. On the other hand, well-motivated and properly focused physicians play a key role in leading quality, financial, compliance and other improvements in health care organizations and practices.
